The Ottomans experienced their highest point of strength during the 16th century, as Turkey was trampling across Europe gaining victory after victory. As the Ottoman soldiers pushed into new areas of the continent, the Europeans increasingly became fearful of the Turks. Yet, . . even after the Ottoman Empire lost its great status and became the "Sick Man of Europe," a hatred and dread for the Turkish people remained. This was a lingering of ethnic and religious loathing against a people of unknown background; It was a vile revulsion by Christians against the Muslim Turks-a people that did not profess a belief in their man-god. "The Turk is a great barbarian," stated 16th century German humanist John Adolph Muelich. In the German language, türken ("to Turk"), still means "to hoax, to deceive."
The 18th and 19th centuries witnessed Christian missionary adventurers roving the Orient probing for new victims to entice into their fold. In addition, Western intellectuals and pseudo-intellectuals traveled to Asia in search of undiscovered ancient worlds, and throughout their voyages into Ottoman lands, wrote profusely about the Turks-the less than human savages. In an early account about Palestine, an American wrote that the Turkish army provides a "severe beating" to its new soldiers, including those which were "sick." He documented that "some of the new recruits die" and that "the whip of soft, flexible, stinging leather, which seldom leaves the Turkish officer's hand, was never idle."
In a popular 19th century British travelogue, the Protestant author calls the Turkish people both "savages" and "cunning misbelievers." In this same volume, the office of the Sultan is referred to as "faithless." The author writes, "The Turks abated nothing of the cruelty in which their race has always taken in delight." This Christian author also uses the term "stubborn." The term stubborn is one that was frequently used by Christians against non-Christians. It is essentially a slur, which dictates that there is something wrong with the non-Christian for not accepting the Christian faith. We repeatedly see the use of the word stubborn used against the Turks, as well as the Jews for not believing in Jesus. This word has been employed by Christian missionaries both in centuries past, as well as present. Hugh Latimer, the chaplain to King Henry VIII wrote in one of his sermons, that the Turkish people were not only stubborn, but he wrote, "It is a great ignominy and shame for a Christian man to be bond and subject unto a Turk." Reformist Martin Luther himself wrote extensively about the "Turkish problem" and considered the Turkish people "servants and saints of the devil." Turkish people were so vilified and associated with negativity, that the term Turk was (and is) itself used as a slur, even when not talking about Turkish people.

The Republic of Turkey is a nation that over the past sixty years has become a truly modern nation. And as their society seeks entrance into the European Union, it continues to struggle because of persistent age-old negatives. For Turkey to be viable as a member state of the EU, the civilized world must expunge old stereotypes. The world must also recognize that the Republic of Turkey, although principally a nation made up of people born into the Muslim faith, is not an Arab nation with discordant goals and attitudes like those that fester inside the Arab world. In April of 2007, when over one million Turks marched in the streets against a potential pro-Islamic Turkish government-we were once again assured that Turkey remains a free and modern nation.
As Turkey aims to enter the EU, the other major obstacle it faces, are claims by the so-called Armenian genocide lobby. Because the Turks deny there was an organized attempted genocide against the Armenians, Turkey remains a villain among international political circles. This begs the question, why should the modern government of the Republic of Turkey accept blame for the result of warfare between the Ottomans and the Armenians anyway? And, since it has been established that this was a brutal and tragic war, and that both sides suffered greatly, why are the Armenians fostering a political claim? Even without answering these questions, the never ending ranting by the Armenians against the savage Turks has fallen upon the ears of the Western world and has been responded to in knee-jerk fashion. The Armenians have not only gained the support of the Christian world, but also the main stream Jewish establishment. Even when esteemed historians with no Ottoman or Turkish allegiance, such as the late Prof. Stanford Shaw (UCLA), Prof. Bernard Lewis (Princeton University), and Justin McCarthy (Univ. of Louisville), all agree that the so-called Armenian genocide was no genocide, the Christians continue to support their fellow Christians, and the Jews-as usual, blindly support the self-declared victim.
It is the erroneous Jewish position that remains the saddest truth in this whole matter. Without deep investigation or analysis, the secular Ashkenazim that make up 99% of the Jewish establishment have emotionally and completely sided with the Armenian Christians against Turkish Muslims. If you are part of the Jewish community, and you outwardly go against this thinking, you risk losing your employment, being censured or risk marginalization by the bully establishment; it is for this reason that almost no Jewish organization has visibly come out to counter the forged claims of the Armenians. Recently, a (Jewish) US Congressman spoke at a pro-Armenian rally in New York City, where he claimed the Jewish people "all supported" the recognition of the alleged genocide; this was not the first time a Congressman spoke out on the issue, nor the first time a Congressman was mistaken.
In 1989, as Armenian lobbyists were making headway in the Congress for the US to recognize their genocide claim, Los Angeles based Rabbi Albert Amateau (1889-1996), an orthodox rabbi, attorney and social activist, told that as a young man in Turkey, he was mistakenly considered a Christian because of his French name. Because of this, Armenian students felt that they could freely discuss their membership in Armenian secret societies around him, and openly discusses their active participation in secret military exercises to prepare themselves for military duty in their planned subversive war against the Ottoman Empire and nation, in alliance and collaboration with Tsarist Russia. In a sworn statement, Amateau told that he was:
…Amazed that intelligent and politically astute gentlemen, such as Senator Robert Dole, the leader of the Republicans in the Senate, and others…have been importuned to sponsor [a] resolution without any proof of the veracity of the Armenian claims...They have been duped to believe the Armenian allegations as true.
The Jewish establishment should not allow their communal emotions dictate their responses. They must realize that because a group of Armenian Christians accuse Turkish Muslims of committing genocide, it does not mean that it actually happened.
Combining a lack of knowledge of Ottoman and Balkan history with the deeply entrenched pro-victim attitude existing on modern university campuses, allows the leftist university professors to continue to teach that the Armenians experienced a genocide. As stated earlier, even though there was a war between the (now long gone) Ottoman Empire and the Armenian people-and we know it was a universal tragedy-there is no reason to blame the government of the modern Republic of Turkey. War, is war-one side wins, and another loses. Because there is no Sultan to defend himself against Armenian allegations, does not mean that those allegations are now established as factual.
Western cultural arrogance combined with a limited world-view contributed toward the initial hatred of the Turkish people, and their subsequent slanderization over the centuries. British Professor Richard G. Cole summarized the problem in one sentence; he wrote in 1972 that a stereotype of the Turk was, "frozen into print culture in the late 15th and early 16th century and remained there." Today, in 2007, Christian elitists with pro-European attitudes and a hatred for all Muslims, remain focused against the Turkish people.
Turks do not deserve to wear the title of savage or ethnic cleanser. Historic descriptions of the Turkish people are remarkably biased and inaccurate and remain a blight among all decent and civilized people. Modern society must scrub away the vestiges of a lingering harmful and unfair typecast.

1724) Australian Federal Parliament MP Mal Washer’s Response To The Petition
Dear Friends,
I attach for you below a response I received today from Dr Mal Washer’s (MP) office in relation to the petition that has been handed up for presentation to Federal Parliament. Most of you will be aware of the petition others will not (by others I am talking about our friends overseas in the UK, US, Turkey, Germany etc). This petition was forwarded on by me to numerous entities in Australia including all the Turkish Media newspapers etc and friends.
I wish to sincerely thank those of you that assisted in this petition and arranged signatures to be obtained, I must personally mention and thank the following people,
Gurel Ismail, Efe Yaman, Bahidair Hoca from Wollongong, Cahit Yesertener, Huseyin from the Islamic Association of Perth.
We collected a total of 753 signatures from Turks and friends of Turks Australia wide. 523 of those signatures were from Perth Western Australia the remainder from Wollongong and Sydney. No signatures were obtained from Victoria Melbourne, or Queensland. There are approximately somewhere between 100,000 to 150,000 Turks living in Australia.
For those people that signed and supported the petition I truly thank you, as you will see from the below message the petition is due to be tabled in Parliament on the 20 June 2007.
For those of you that are unaware of the petition’s content or wording I attach a copy just for your information. I suspect when the petition hits Federal Parliament there will be significant media coverage by the main stream Australian media.

Hi Ataman,
I was wondering about your petition and have been keeping an eye on its presentation which has not happened when you consider it left out office in Joondalup on Wednesday the 16th May, 2007.
I rang the tables office to track it down and I was advised that the whole petition has been sent back to Joondalup because to have a petition read by the Clerk in the Chamber it has to be correct. Your petition failed because each page had to have the prayer etc on each page.
I asked what I could do to speed this up and I was told the we can resubmit an "Out of Order" petition through Minister Tony Abbott's office and these are done on the second Thursdays of sitting which will mean it will be read on the 20th June as an "Out of Order" petition.
I will organise for this petition to be resend to the appropriate office and I will keep in touch to let you know when it is read.
Remember when tabling a petition through the Tables office each page has to have the prayer etc followed by the names in original ink not photocopy.

The petition of certain Australian citizens draws to the attention of the House.

Members of the Australian Turkish community have long suffered from acts of terrorism, most specifically the murders of Mr Sarik Ariyak former Consul General of the Republic of Turkey and his bodyguard Mr Engin Sever in Sydney in 1980. As well as the Turkish Consulate (Melbourne) bombing in 1986. These acts of terrorism were conducted and carried out based on a fallacious cause, namely the Armenian Genocide claims. The Australian media and most particularly The Special Broadcasting Service continually airs damaging one sided biased reports without ever putting to the Australian people the full facts of those tragic events which took place during the material times of the alleged “Armenian Genocide.”
Your petitioners therefore pray that the House

Passes a resolution (agreeing with the current British Parliament) stating that the events that occurred during World War I at the material times in Eastern Anatolia then a part of the Ottoman Empire can not be described as the Ottoman Empire committing a Genocide against its Armenian population.
The Australian Government recognizes the fact that the British Government of the day occupied the former Ottoman Capital of Istanbul and conducted a thorough investigation of the allegations, after having arrested and conveyed to the then island colony of Malta 144 Ottoman Officials both Military and Political. These prisoners having been incarcerated on Malta for over two years without charge were eventually released and Lord Curzon forwarded onto the British Government of the day an official telegraph declaring that there was no evidence with which to charge any of the subject Ottoman leadership with the charge of “Outrages against the Armenians” in fact Lord Curzon stating that he could not even reach “Prima Facie” level. Subsquent and consecutive British Governments have stated that the events that took place during the material times can not be described as an “Armenian Genocide.”
That the House urges the Australian media to fairly and impartially report on the events during the material times of the alleged Armenian Genocide, and in particular request the Special Broadcasting Service to air the independent documentary “The Armenian Revolt” produced by Mr Martin Callaghan.
That the House amend the relevant legislation, most specifically the Trade Practices Act in order to demand media responsibility and accountability in the way the Australian media promotes and reports on events so as to make sure that they do not participate in misleading and deceiving the Australian public in all matters which they report upon. Further, that legislation be amended so that the Australian media conduct appropriate due diligence inquiries into the truth of matters they report upon before they promote and report upon those matters. That the Trade Practices Act be amended so that Australian citizens can commence legal action against media corporations and utilize the enforcement sections currently available only to the Australian Consumer and Competition Commission, namely seeking the appropriate Court to fine media corporations for any breach of the Trade Practices Act, but most specifically misleading and deceptive conduct. As it stands currently only the ACCC can invoke those sections, which is a barrier to justice.

1723) "I Am Proud That I Am Hakob Vardovian's Grandchild," Former Rector Of Van University Says
Yucel Askin, the former Rector of the Van University affirmed that he is the grandchild of famous theatrical figure Hakob Vardovian (Gulli Hakob). .
After being arrested Yucel Askin for the first time spoke about his origin, stating: "My father's father is Hakob Vardovian. He in future adopted Mohammedanism and took the name Yakup. He is the founder of the Turkish theater. I am proud that I am Hakob Vardovian's grandchild, but neither me nor father had any tie with Armenians. I know myself as a Turk and a citizen of the Republic of Turkey. And as for the events taken place in 1915, in my opinion, it is a human tragedy. I am not all stooped by the fact that my grandfather is Vardovian."
To recap, Van University Rector Yucel Askin was arrested on October 14, 2005, because of some problems arisen in the contract of transfer of the money connected with getting medical equipment at the cost of 25 mln dollars for the research hospital of the medical faculty. The latter was presented the accusation "of creating a criminal group for mercenary motives." The Rector for the first time arrested in the history of the Republic of Turkey on December 28, 2005 was set free.
The Rector's arrest met counteraction of the scientific circles of Turkey who opposing parties joined, as a result of what that issue got a political shading. And after the issue when Yucel Askin's having Armenian origin started being speculated by deputy of the Justice and Development party Ramazan Toprak, Constantinople Armenian Patriarch Mesrop II Moutafian presented here a serious criticis, stating: "Honourable Toprak spoke about Armenians in such a way as if being an Armenian is a crime or means a much worse thing. Similar racist expressions were inadmissible in modern democratic countries."

1719) Unarmed Armenians? Photos Say The Reverse
No Comments, But Photos
Dr. Nilgun Gulcan said "the Armenians committed genocide against the Turks of the Ottoman State and the testimonies, archives and the photos prove it."
Dr. Gulcan continued further: . .
"The radical Armenians say that the relocated Ottoman Armenians in 1915 were unarmed and innocent people. However the photos and the official documents say the reverse. The New York Times reported that hundreds of thousands Armenians were armed and ready for a war at that time. The following testimony of Russian Lt. Colonel Toverdohleyov also shows the clear fact:
"More tan 800 unarmed and defenceless Turks have been killed in Erzincan. Large holes were dug and the defenceless Turks were slaughtered like animals next to the holes. Later, the murdered Turks were thrown into the holes. The Armenian who stood near the hole would say when the hole was filled the corpses: "Seventy dead bodies, well, this hole can take ten more." Thus ten more Turks would be cut into pieces". (Gunter, p. 18-19)."
Mrs. Gulcan also showed a photo to our correspondent about the Ottoman Armenians:
"The photo published below is also another proof that the Armenians in the East were armed and they were attacking the Ottoman Army and the civilians.
' Fedayee' (terrorist) group fighting under the ARF (Armenian Revolutionary Federation) banner. Text in Armenian reads "Azadoutioun gam mah" (Liberty or Death). ARF is responsible for murders of thousands of Turkish villagers in the East.
"More than 520.000 Turkish and Kurdish civilian people were slaughtered by the Armenian gangs during the First World War years. Thousands of Armenians also joined the Russian and French armies against the Ottoman Army. Tehcir was the only way to save the Ottoman soldiers and the Armenians near the war theatre were removed to the Syrian province. Now the Armenian militants name the 1915 Campaign as 'genocide', without touching none of the Armenian mistakes. The Tashnaks in particular played a crucial role in the 1915 Tragedy and now they still play a similar role in spoiling Turkish - Armenian relations" Gulcan added.

1718) Art: Edik Balaian Helps Armenians And Turks Look In The Mirror
Using ink and lead as his weapon, cartoonist Edik Balian creates an animated discourse between viewer and artist. Edik's cartoon's are rife with political satire. He uses his cartoons as a tool to examine the pith of current political issues. His cartoons primarily investigate the complexities of Armenia's vertiginous history and explore its current political ironies. .
Balaian uses his caricatures to bring consciousness and new perspectives to intense social and political situations. The main character in his cartoons is named Dodop, a hapless-looking character with an exaggerated nose and mischievous smile. Dopdop is the reoccurring character in almost all of Balaian's work. His persona is always shifting. Dodop cannot be pigeonholed. He constantly inhabits different roles within the story line of a cartoon, Balaian portrays his protagonist in various guises so that the viewer will be able to contemplate all angles of a certain issue and employ varying perspectives. In one cartoon, Dodop will be an Armenian government official; in another cartoon, he will be a Turkish soldier. Dopdop can also be depicted as a mere plebian. Dodop appears to be a dopy and feeble character, but behind this facade lays a character that is underlain with profundity. Balaian created Dodop as an archetype that readers will quickly recognize.
Balaian explains "Dodop is everybody all at once, and many times he is nobody. I use him as a symbol to assert certain opinions about social and political situations."
He continues, "I don't like to draw real people or known political figures, because when I do that people will make assumptions. Instead I use Dodop to communicate ideas. This helps bring awareness to the immediate action, rather than draw focus on a particular person."
Balaian's cartoons vary from the subversive to the downright hilarious, but whatever the image may be, all of Balaian's cartoons resonate a tone of seriousness. Some newspapers in the past have wanted to censor Balaians's work. "Drawing political cartoons is a form of journalism. The cartoons address issues that are current; cartoons are created for the present time, illuminating serious issues in a humorous way. Sometimes the cartoon may be too abrasive for viewers, but our community must be able to embrace these cartoons and enjoy them for what they are."
Some images in Balaian's oeuvre include a series of the Mother Armenia statue confronting issues of Armenia's newfound independence. The use of Mother Armenia is a recognizable emblem for all Armenians. Balaian uses Mother Armenia as a symbol to illustrate the dichotomy between life during the Soviet era and the new independent Armenia. One example is Mother Armenia laying on a hospital bed in an operating room. She looks very ill and has surrendered her shield and sword. The doctors who are in the room are intentionally ignoring her and instead are busy gallivanting and playing games.
Balaian's work is underscored with a weight of subversiveness, empathy, and frankness. Many of his cartoons examine the polarization between Armenia and the diaspora. In several of his cartoons, a diaspora Armenian can be identified as a Dodop sporting a "Kiss Me I'm Armenian" T-shirt. In one tableau Armenia is seen as a floating lamdmass in the middle of the ocean, about to sink. One little Dodop is sticking his finger in a hole in the land so that the land does not sink. The diaspora Armenian is removed form the landmass, smoking a cigar and analyzing the problem from afar. Balaian says, "I see this a lot in the Armenian community. Everybody is apt to criticize the government and policies in Armenia. I see people always expressing their views at coffee houses. When I ask them why they don't do something about these problems, they turn to me and say that is not my responsibility."
Balaian believes that every Armenian has a responsibility toward helping Armenia in whatever capacity it may be. Balaian's contributions, among other things, are creating political cartoons that bring awareness and action into the community. "Unfortunately, we don't have serious political cartoons in the Armenian newspapers. This form of art is much needed."
Balaian's cartoons usually deal with sensitive subjects. He is keen on attacking these issues with satire and wit. Balaians described one of his favorite cartoons "The drawing shows a big chair that is falling though the cracks. Through the falling crevices the words Human Rights, Democracy, Economy are etched in the fractured foundation. The chair symbolizes the government. The chair has a missing leg, and a Dodop dressed in a Turkish military uniform is trying to hold up the one leg of the chair. This shows that Turkey's only strength lies in its military prowess; beyond that, the government is tarnished with corruption and a dishonest past."
Edik does not remember a time when he was not drawing. From his youth to the present, he has produced a trove of cartoons, sketches, and various drawings. He had his first cartoons published in Iran when he was only 15 years old. Many years after that he continued to draw cartoons for newspapers in Iran, primarily in the Tamasha and Kayhan newspapers. In 1985 he moved to France and began creating cartoons for French publications such as Le Matin and Broadcast Magazine. Edik now lives in Glendale, where he spends most of his time with computer graphics and continues to create work for various Armenian newspapers, Balian realizes that there is a severe shortage of outlets for his cartoons, especially in Armenian publications. "There is not a lot of opportunity for me to create work for Armenian newspapers. Most papers are either partisan or the budget does not permit for cartoon sections. This is a shame because satirical cartoons are perhaps one of the best ways to reveal truths to the pubic."

1716) An Interview With Rev. Krikor Aghabaloghlu Of Istanbul and Reader's Comment by Sukru Server Aya
During the week end of May 17-21, the courageous "Baadvelee" (Reverend) Krikor Aghabaloghlu, the pastor of the Gedik Pasha Armenian Evangelical Church in Istanbul, visited the Armenian American community in San Francisco.
Rev. Aghabaloghlu was invited by Rev. Nerses Balabanian, the pastor of the Calvary Armenian Congregational Church of San Francisco.
Rev. Aghabaloghlu delivered enlightening and insightful remarks during the Saturday evening banquet. The banquet took place on May 19, at the jam-packed hall of the church. His speech was interrupted by thunderous applause and at times with standing ovations. Rev. Aghabaloghlu also delivered the Sunday sermon in the church, filled to near capacity.
Rev. Aghabaloghlu gave an interview to USA Armenian Life Magazine on Sunday just before his departure to New Jersey. The following is the first part of the interview: (The second and final part will be published next week.)
USA Armenian Life: "Baadvelee" Welcome to the USA.
What is the primary purpose of your visit to the United States?
Rev. Krikor Aghabaloghlu: Thank you. The Armenian Brotherhood church in New Jersey has invited me to deliver my message to the community. There is a chapter in the Holy Bible where Isaac's children had dispersed. So Isaac calls upon his youngest son Joseph
to go see what happened to "your brothers, and what they are up to? Bring me their news.”
So, I think, God has prepared me and said: "Son, I am sending you to go see your dispersed brothers. See how they are living. What are they up to, and encourage them. Talk to them. Preach to them and encourage them.” I thank God for that. For I have many brothers who are inviting me to come and see them. On Monday, I
will go to New Jersey. I will stay there for one week and I will preach to the Armenian people.
Once in a while, invitations arrive, and I don't turn them down, because I am God's and the Armenian people's servant. What is the duty of the servant? If the Lord calls, the servant goes. Our Lord has called me too. So, I shall go and serve Him and my brothers.
USA Armenian Life: You are famous around the world for being a courageous Armenian spiritual leader in Turkey, who without any fear states in what is now called Turkey, that today's Turkey was founded on the ashes of Western Armenia. During past direct
broadcasts on Turkish national television, you have intrepidly told the Turks directly: "Enough with your denialism of the facts of the Armenian Genocide!" Where does the power for such courage come from?
Rev. Krikor Aghabaloghlu: For one thing, I was born in Anatolia and I have experienced many hardships. Because...
USA Armenian Life: By Anatolia, you mean Western Armenia?
Rev. Krikor Aghabaloghlu: Let's say Western Armenia. Because, we are used to and are taught to refer to Western Armenia as “Anatolia.” Now, Western... let's say historic Armenia. Because, where I was brought up, it's not an easy thing to stay Armenian and to live as a Christian. I have experienced too many hardships and persecutions. I have seen many acts of ill treatment. You do good deeds but you are "remunerated" by bad deeds. Yes!
There are very good people who do good deeds and you become joyful and you say that "yes you understand that this is human.” The human being shall be like that. But if you do good deeds and you get maltreatments in return, you do not forget.
... In Turkey there are a few very powerful people who are like that. There are families. And there are government officials who do not like the Armenians. Because the following lies in their hearts: "Why has the Armenian people throughout one thousand years [Editor- Since 1071 AD when the Turks first invaded Armenia] live with us and have not become Muslim and were not Turkified?" They cannot accept that. That's why they say: "If they live in Turkey, they should have become Muslim and been Turkified." If you say,
"I'm Armenian," you touch the eye like a thorn or a needle. He becomes unsettled. Whether you do something or not, the man is like that. His nature is like that. Oh! You shall be tortured. You shall loose your homeland. You shall loose your schools; and your homes will be taken away. Your churches shall be confiscated. Your people shall decrease [Ed-in numbers]. And then they will curse at you. You shall listen. And after all that they shall tell you that
"you're guilty!"
For how long, for how long, one can keep quiet? I don't know. This is my nature since my childhood. But I could not keep my mouth shut. My father also, wherever he used to go, he would say: "I'm Armenian and Christian."
I was very little and I used to say: "Hayrig (father) why are you saying: "I'm Armenian and Christian? People are not asking a question like that!" He used to say: "My child when you grow up, you'll understand!" When I grew up I began to understand. I understood that to be Armenian and to be Christian in Anatolia was a hard thing to do. They always speak against your religion; against your nation; your family, your blood. You know, they always talk!"
I have been a teacher, history teacher. I have encountered many hardships in Western Armenia. And now God has called me and I have recognized God's power and have acquired that power. And now that power brings through my heart such an empowerment that you can’t express with words. It’s such a great power.
Jesus said: "The Holy Spirit will remain inside you and you shall acquire power."
While acquiring that power, Jesus said: "Now, I am parting to be crucified.” His pupils said: "What are You saying. They will kill you." Jesus replied: "I have come for that moment. If dying is needed, I'll go and die." Later, the pupils said: "OK we also will go and die." If you have that kind of love, you'll learn from Christ!
For Jesus, dying is nothing. It was a gain. Later, you too say, for the truth, for the right, for my nation, dying is a game. If need be, I can die. One and one half million [Armenians] have been sacrificed. The odor of their blood permeates my nose. I remember, because I was a child. During my childhood, the elders
used to narrate how their fathers and mothers were massacred. They were crying as they were telling. As a child, I used to hear and hear, and hear these things.
Later, again we were subjected to ill treatment during the republic era. Up to now, the government has not changed. It came up with laws in 1941-42. It took away all the remaining riches from the Armenians. It did the same thing in 1955.
USA Armenian Life: Are you referring to "Varlic vergise" (Possession taxes)?
Rev. Krikor Aghabaloghlu: They did it against the Greeks in 1955. But also they did it once more, against the Armenians.
Later, 1974 was unforgettable. It was impossible! I can't come up with a name for it, even if it needs to be defined. I can't name it. It was inconceivable. If you claim that it was a law, it did not fit. Then, the government says: "The churches’ becoming rich hurts the government.” And it confiscates all the properties from the churches.
Is this possible? So, the church initiated a lawsuit insisting that it had purchased these properties with money, therefore, it said: “Compensate us.” The government replied: "There is neither any money, nor any buildings for you."
It's impossible.
We have spoken out. Europe did not understand it. It is only now that Europe has awakened.
But the government will do bad deeds against the church and the Armenian people, then shamelessly it will write in schoolbooks that the "Armenians have back-stabbed us." How did they backstab you?
Now the era of the republic is laid open in front of us, isn't it?
Can our government people say: "during the days of the republic, the Armenian people [Ed- in Turkey] have done this one bad deed???” Have you heard that they have?
USA Armenian Life: No!
Rev. Krikor Aghabaloghlu: Can anybody prove that? Good! In 1915 one could claim that the Armenians massacred the Turks. Or you can claim that the Armenians sided with the Russians.
USA Armenian Life: They are coming up with pretexts.
Rev. Krikor Aghabaloghlu: Now what? This proves one thing: That is the habit of the Turkish government. It always likes to confiscate. Look. The people's heart is good. The majority of the Turkish people are good. They like the Armenian people. They know the
Armenians. But what happens? The government people, the official people or the military people always talk, talk, talk and by talking and talking, they misguide the people. They fill the people's hearts
with bad stuff, you know my brother. So what will happen to them? Oh, they will say: "our professors are advising as such. Undoubtedly they are right, because they are our professors.”
USA Armenian Life: In your remarks yesterday, you clearly defined the confiscations from the Armenians during the 50's and the 70's as economic genocide...
Rev. Krikor Aghabaloghlu: Yes, yes! I'll arrive to that. Yes, in my opinion, that is economic genocide. There is no other definition.
You can't define it any other way. They always take and take. Then they shamelessly say: "we have taken nothing. We don't say anything and you, (Armenians), are lying." How do we lie? Right then and there, if you are a believer, if you recognize Christ, His courage permeates you. And you say: "If sacrificing is needed I can not abstain from speaking out.”
When I entered into the church and became aware of these problems, I said to myself: "This is indigestible! I can't digest it and will speak out.” And I began to speak out.
It is for that reason that I wish to tell the majority of the Armenian people who live in Europe and America that they don't know the truth about the situation of the Armenian people in Turkey. Many among these people will tell you: "we're doing well. We're obedient, because, from time to time, they show individuals on
TV.”
Where do they find them? I don't know! The name sounds Armenian. But the heart is not Armenian. They say: "we're obedient and well. There's nothing going on here." Oh man! What kind of Armenian are you?
USA Armenian Life: Totally enslaved!
Rev. Krikor Aghabaloghlu: How can you be an Armenian! How blind are you that you can’t see. Or how cowardly are you that you can’t speak out!
I can't comprehend that an Armenian can be this cowardly and say: "We're doing well."
Well it shall be good. It's my homeland. I've not come from the outside. I'm not a beggar. I'm not asking for mercy from the Turkish nation by saying: "Please, I have no place to go to, no home to dwell in. I have no homeland. Accept me in. Let me live here."
I am not like that. Western Armenia is my motherland. I've been living there since four thousand years and if money is needed to be paid I'll pay taxes. Is there a need to serve in the Army? I'll do that as well. I'm not a beggar. Yes, I'll live well. Why not? Why not?
If others live well, we also will live well in our ancestral lands. ...
I'm very joyful that the churches are open. What else? Can you teach Armenian history in your schools?
Now the Turkish people in Europe are erecting mosques. Is that not true? Europe is Christian. She says: "You're Muslim. Come and open your mosque. Open your school and at the same time, during your holidays, take your Turkish flag and walk in the streets. Can’t
they do it? They can! Don't they?
USA Armenian Life: They have freedom.
Rev. Krikor Aghabaloghlu: Aha! Now, can you do it?
USA Armenian Life: In Turkey?
Rev. Krikor Aghabaloghlu: For once, can you, as Armenian in Turkey...
USA Armenian Life: And as an indigenous people...
Rev. Krikor Aghabaloghlu: Yes, can you take one Armenian flag and observe a holiday? Can you do it? What kind of freedom is that? How free are we? Can you teach your own children in the Armenian school the Armenian history?
In all the schools, the vice-principle must be a Turk, whose job is to keep an eye on your activities. Now are you free? How free are you? You like to move the church from there, because the number of your people has dwindled here. Now there are other neighborhoods. Can you relocate your church and build a new church? Can you build? You can't build! According to the new
law of two years ago, when Turkey was trying to enter the European Union, "Yes, from now on, the churches can be repaired. The government people are respecting to us in every way" Can you repair your church as result of this new law?
But the Turkish nation in Europe is so comfortable. I am happy for them, they deserve to be comfortable. Why not? But I want to do the same thing here in Turkey. But I can't do it. I can't!
USA Armenian Life: Meaning that in emulation of whatever freedom the Turkish people are experiencing here in the free world, the Armenians are not able to do the same in their own ancestral lands.
Rev. Krikor Aghabaloghlu: Yes, in their ancestral homeland!

So, on the occasion of these murders and according to many sources, there is a forecast that these events will become more frequent. Do you agree that this will be so?

USA Armenian Life: Later on, if possible, please give some details on the third murder. The first one was on January 19, when the extremist Turks murdered the Armenian journalist and editor of "Agos" Hrant Dink. The second one, if I'm not mistaken, was on April 18, in Malatia when three non-Armenian Christians - one German and two Turkish Christians - were murdered. So, on the occasion of these murders and according to many sources, there is a forecast that these events will become more frequent. Do you agree that this will be so?
Rev. Krikor Aghabaloghlu: My brother, now you know what can happen. During the last few years, the missionary work has multiplied.
Why did it multiply? Because the Turkish people are sending missionaries to Europe. The Muslims are preparing missionaries and are sending them to Europe. They are saying, "We should Islamize all of Europe. We should Islamize all of America." They are working very hard by making a lot of effort. The European Christians and the American Christians are saying, "These people are coming and they want to convert us to Islam. So, let's go to Turkey and let's preach!"
USA Armenian Life: Convert them to Christianity!
Rev. Krikor Aghabaloghlu: That's it! It's not something else. But for them "all roads shall be open. For the Christians the roads shall be obstructed." That's not fair! If you do as you like, in return others have to be able to do what they like.
USA Armenian Life: There should be equality.
Rev. Krikor Aghabaloghlu: Yes, there should be. Some people come forward and claim: "No! These people are not coming to preach Christianity. They are coming to take our homeland away from us, to divide us. They are coming with bad intentions."
And the Turkish people are obedient to their superiors. If one lone (Turkish) professor asserts the way things are, they’ll blindly believe him. The masses begin to believe that "missionary activity is a bad thing; these people are not coming just to distribute the Bible. They have a special plan thing. They will undermine Turkey and take it away from us. Then what! The entire Christianity is our enemy."
There is something else: America went and hit Iraq. Isn't that so? Now, they are saying: "Why did America hit Iraq? Iraq is Muslim, that's why! They don't want Muslim countries to prosper. Also, all Christians are the enemies of the Muslims."
They always talk, talk, talk like this. And they write in the books and via the television. They fill the people's brain. Then, what will the average people do? It will become the enemy of the Armenian people, the enemy of the Christian Turks, because Christianity is animosity for those people. "They are trying to take his country away from him."
And there is the secret government and military people (the Deep State/).
Let me tell you. There is a retired colonel, a government person who after my televised talk told his Christian neighbor: "Had this Krikor lived on my street I would have killed him or would have expelled him with his family. He would not have been able to enter that street." He lives in the Army. Now he is retired. This shows that there are people like him who have animosity against the Armenians. What do they do with that?
These people or the secret police secretly infiltrate among the youth who congregate in big cities in great numbers and through secret methods relay to them thoughts such as, "I wish someone would kill Krikor. We would be so happy. If you do it, you will be a courageous person. You will be a hero! And then what will you become? We will hand the Turkish flag. We'll take your photo." You have seen similar photos haven't you?
USA Armenian Life: Yes.
Rev. Krikor Aghabaloghlu: Isn't it so? This shows that that flag is tarnished with Christian blood. And these people feel proud and encourage others. Now he enters into prison. And how do they greet him? Do you know how? Like Turkish princes. And he gets encouragement from other youth.

What message would you like to relay to the Armenian Americans and, for that matter, to the entire Diaspora Armenians?
Rev. Krikor Aghabaloghlu: Brother, now, in a foreign country, the people are comfortable. The comfort brings heaviness upon the man. It brings sleep. Now we are over there, in a Muslim country. There is always a watcher. They keep you awake.
And you exert effort to stay awake. Here, (in the Diaspora) there is no problem. They come her and they go to sleep. They indulge in European traditions. They submerge into the lifestyle and they get lost!
I do not want the Armenian people to be assimilated in Europe. I do not want to go into oblivion. They should flourish even more. They should be awakened even more. Here, everything is in your hands. You should grab it and use it so that you can introduce and promote the Armenian nation among other nations. This is necessary. That is why I come, and speak courageously with God's grace. I want to encourage people, to awaken them, and to promote unity. That is the most difficult thing, because for many years, there hasn't been a strong organization that could bring us closer, you know.
There is only the Genocide issue. But besides that, we need to know more that we're Armenians.
USA Armenian Life: Meaning that we need to be guided by national awareness.
Rev. Krikor Aghabaloghlu: Aha! Yes! A leader is needed. A strong leader is needed. A Governor is needed. Oh! There is no government. Now, Armenia’s is something new at 16 years of age. Before that, we've been living under other countries’ rules. We should tell them that we would like to become a nation. Yes! Let's earn it!
Now look! The people of Turkey are intelligent. They go to Europe, send money to Turkey. They learn everything and they start working in Turkey. We also must acquire, earn and make Armenia stronger. There is a lone Armenia and there is a lone flag. There is nothing else.
On the other hand, the other objective is to strengthen Christianity, because, our Armenian people are chosen from among other people. We're the first nation that embraced Christ. We feel proud. But if you ask "who's Christ?" the Armenian child doe not know. The Armenian family does not know. It's painful for me. How could it be that in a free country, the churches are empty? How could it be that all he churches are empty? You cannot be an Armenian only on April 24 or during a holiday. Our Armenian people have been sacrificed for just being Armenian, for just being Christian. Yet, they have preserved Christianity. They have not said: "Yes, when give up Christ I will win." They haven't! Had they said it, they would have been cursed.
USA Armenian Life: Do you have faith that our people's just cause will be solved justly in the near future?
Rev. Krikor Aghabaloghlu: If we trust in God, not ourselves, our minds. And if we take this issue before God with one heart, and if we are filled with spiritual genius, if we find a language for effective communication and speak from within the heart of foreign countries and I wish and pray that God would give us spiritual genius/wisdom then the case will be solved.

I have read your interview with interest and much surprise. I believe that I have seen the nice looking Rev. Kirkor on TV few times, very fast and fluent speaking in Turkish, joggling with lots of words without essence much like a stand-up anchorman. Now I understand that he received an invitation from the much richer US Evangelical Church, and although he has a very limited protestant community at his Gedikpasa Church, he already started to boast and bombard, to satisfy the expectations of the host and reimburse the invitation. The remarks of Kirkor effendi are so fresh – biased that it reminds me the lies a century old. When Kirkor efendi will be back he will either deny his words, or will shout that he cannot use his “freedom of speech” to speak lies or slanders. Anyway, Rev. Kirkor, takes refuge under biblical teachings, for arguments involving science and knowledge. Since I have no desire or brains to get tangled on divinity myths, I abstain from commenting on this long interview which should have pleased all readers of USA Armenian Life Magazine.
b- I have just received a PPS show which lasts about 25 minutes and it is an interview with a Turkish professor in USA, regarding the scientific approach and paradoxes with the Qoran. To me, all holy books are more or less alike, all of them written by clergymen, having same objective to immerse intelligence under mythology.

I do not mind what Kirkor effendi said, but I do mind what Mesrob II says, since I knew him to be balanced, prudent and compassionate, which built his reputation as a trust-worthy personality. However, I must say that after having read his interview, I have decided to share it with you providing an English translation as below, for those who cannot read above web site in Turkish. I have jotted my counter-commentary numbers on the translation, and the readers may wish to read what he said, and what I say for what he said. I am also taking the liberty of sending a cc to the Patriarchate in Istanbul, since I believe that we must love and understand each other with our existing differences and values which we jointly share.

Mesrob II said that he will talk to General Buyukanit in relation to the murder of Hrant Dink and made a self criticism.
Mesrob II, who talked to the Internet of Der Speigel Magazine, said that those behind the murder of Hrant Dink, are being protected and he will talk to General Buyukanit, Head of General Staff.
Mesrob II, head of Turkish Armenians said that the support given after the murder of Hrant Dink, editor of AGOS paper, with loud shouts of the slogan “WE ARE ALL ARMENIANS” is decreasing, because of nationalist pressure.(#1) and that those behind the murder are protected (#2) and that he will soon talk to General Buyukanit (#3). Mesrob II talked to Der Speigel’s Internet as follows:
“We are receiving blackmail letters continuously. Those letters write ‘we know where you are and we shall kill you and carry your corps’ (#4). For this reason, recently some Armenian schools were evacuated. We applied to the Governor of Istanbul. He suggested to us that we provide private guards. This sounds funny. Because the first duty of the State is to protect her own citizens (#5). I presume that the number of those who want the minorities to leave the country, is increasing (#6). In particular young Armenians are leaving the country. Most of them go to USA, France and Germany (#7). We don’t want to interfere in the freedom of travel. But we wish to stop this exodus (#8). After the murder of Hrant Dink, people walked on the streets carrying placards writing “We are all Hrant Dink, we re all Armenians” and supported us. But this solidarity has been reduced lately, with the raising voice of the nationalist centers (#9). Those behind the murder of Hrant Dink are being protected. I will be going to Ankara soon. It is gtime to say something to General Buyukanit, commander of Gneral Staff(#10).
We did wrong to the Ottomans:
In reply to a question as regards the evaluation of the pressure of Genocide, Patriarch Mesrob II said: “This tactic will be of no help. Of course we cannot be silent for the bloody incidents of 1915 (#11). But we must also see that the Armenians raised their arms against the Ottomans and made mistakes. And the Ottomans instead of penalizing those Armenians with arms, (#12) exiled all people to Syrian desert and took revenge (#13). This horrible period surely should not be forgotten (#14) but we must go ahead despite everything (#15). Acceptance of the Genocide claim will provide no benefits to us at this time (#16). Because of this attitude of ours, we are frequently under the attacks of diaspora Armenians. (#17). A short time ago the Armenian Federation in USA, charged as for being cooperators of Turks (#18). But I naturally think that the Armenians of Turkey have different opinions from those abroad (#19). Diaspora Armenians want everything to be done in one time. But this is quite far from the realities of Turkey (#20). Instead of insisting on the acceptance of Genocide, we the Turks and Armenians, must spend efforts to improve the dialogue between Turkey and Armenia (#21).
Our Vote is for AKP:
The Patriarch said that Tayyip Erdogan’s government was acting close to them and hence they will vote in favor of AKP. The Patriarch said “if we have to talk the truth, we Armenians, prefer AKP to CHP’s opposition. AKP has a milder nationalist attitude towards minorities. Erdogan’s government is very open to our demands” (#22)

#1: Decrease or cooling off of sufferings over time is normal. This may be affected a little by opposing nationalist feelings remembering that no one expressed even any sorrow when more than 40 Tyurkish diplomats were assassinated by ASALA, let alone any one to protest by shouting “I am a Turk”!
#2: Who protects the murderers, speak in front of the press to Erdogan, you applaud that much!
#3: What does a General Commander of the Army Staff (unless he is military dictator) has to listen or speak to a Turkish citizen whose job is to teach religious rituals! Yesterday 7 Turkish soldiers were killed and 7 wounded when a gendarmerie post close to Iraq border was raided by PKK terrorists, who kill everyday some soldiers by remote controlled mines smuggled from Iraq. Is the General neglect his young soldiers what being killed every day and take special interest in citizen Hrnat Dink only instead of the police? Sir, do you see any sense in what you are trying to say to either boast or please asking special treats to Armenians?
#4: Those blackmail letters sent by some fanatic rascals, is a shame and the culprits should be found and punished for sure. It is also a shame that some schools had to be evacuated for safety against such threats.
More shameful is the advice of the Istanbul Governor to employ private guards ? He reminded me some of the old Ottoman Governors who did not have the means or capability to guard the refugee columns! A century later, the Republic’s Governor acting as Sultan’s Governor ? It is a shame for all of us !

After the introduction of new legislation in previous years, there was little evidence of progress in the implementation of reforms. There were continued prosecutions of people expressing their peacefully held opinions. Human rights further deteriorated in the eastern and south-eastern provinces in the context of an increase in fighting between the security forces and the armed Kurdistan Workers' Party (PKK); there was an increase in attacks on civilians in other areas by armed groups. There were reports of excessive use of force against demonstrators by law enforcement officers during violent protests in the city of Diyarbak¹r in the south-east of the country. In spite of a general decrease in allegations of torture or ill-treatment, there were reports that such abuses were widespread in police custody against those detained during the protests. There were continued concerns about unfair trials and conditions in "F-type" prisons. Little progress was made in creating shelters for women victims of violence.
Background
In December the European Union (EU) partially froze Turkey's membership negotiations because of its refusal to open its ports and airports for trade with the Republic of Cyprus on the grounds of the EU's continuing embargo of the internationally unrecognized Turkish Republic of Northern Cyprus.
In June, Parliament revised the Law to Fight Terrorism, greatly widening the scope and number of crimes punishable as terrorist offences, introducing articles liable to further restrict freedom of expression, and failing to restrict the use of lethal force by law enforcement officials. In July the President approved the Law but applied to the Constitutional Court for the annulment of two articles relating to sanctions against the press. In September the Ombudsman Law was passed by Parliament after amendments. During the year, Turkey ratified both the (first) Optional Protocol to the International Covenant on Civil and Political Rights (ICCPR) and the Second Optional Protocol to the ICCPR, aiming at the abolition of the death penalty.
Official human rights mechanisms, such as the provincial human rights boards under the control of the Human Rights Presidency attached to the Prime Minister's Office, did not function consistently and failed to address grave violations.
Freedom of expression
Laws containing fundamental restrictions on freedom of expression remained in force, resulting in the prosecution, and sometimes conviction, of groups such as journalists, writers, publishers, academics, human rights defenders and students for the peaceful expression of their beliefs.
Many prosecutions were brought under Article 301
of the Turkish Penal Code (TPC) which criminalizes denigration of "Turkishness", the Republic and the institutions of the state. Most of these cases, such as that of Nobel Prize-winning novelist Orhan Pamuk, ended in acquittal.
• In July the General Penal Board of the Court of Cassation upheld a six-month suspended sentence against Hrant Dink, a journalist, who was tried after writing about Armenian identity in Agos newspaper.
Turkish and international human rights defenders campaigned for the repeal of Article 301 of the TPC on the grounds that it lacked "legal certainty of the crime". They rejected the arguments of the Ministry of Justice that the development of case law would signal an end to arbitrary prosecutions.
Other articles of the new TPC of 2005 also imposed restrictions on freedom of expression.
• In October Abdurrahman Dilipak, a journalist with Vakit newspaper, received a sentence of just under one year, commuted to a fine of 10,500 liras (approximately US$7,250), for insulting the President. The prosecutor had called for his acquittal.
• Birgül Özbar¹ô, a journalist for Özgür Gündem newspaper, faced seven prosecutions for "alienating
the population from military service" because of her writings on military service and conscientious objection. She faced possible prison sentences totalling 36 years.
Article 288 of the TPC restricting public comment
on cases under judicial consideration was used in an arbitrary and overly restrictive way to hinder independent investigation and public comment on human rights violations.
Officials of the pro-Kurdish Democratic Society Party (DTP) and those joining pro-Kurdish platforms faced frequent prosecutions amounting to a pattern of judicial harassment.
• The trial of 56 mayors from the DTP began in October. The mayors had signed a letter in December 2005 to the Danish Prime Minister, arguing that the Denmark-based Kurdish television channel, Roj TV, should not be closed down. They were being prosecuted for "knowingly and willingly supporting the PKK."
People collecting signatures for a petition recognizing Abdullah Öcalan, imprisoned leader of the PKK, as a "political representative", received varying sentences, with students receiving the harshest punishments.
Killings in disputed circumstances
There were continuing reports of fatal shootings of civilians by members of the security forces. The usual explanation for these killings was that the victims had failed to obey a warning to stop, but such killings often demonstrated disproportionate use of force and in some cases may have amounted to extrajudicial executions. There were concerns about Article 16 in the revised Law to Fight Terrorism which failed to be explicit that lethal force could only be used when strictly unavoidable to protect life. There were fears that Article 16, which permitted the "direct and unhesitating" use of firearms to "render the danger ineffective", could further hinder thorough and impartial investigations into shootings by members of the security forces.
Members of the security forces continued to use excessive force during the policing of demonstrations. Demonstrations in March in Diyarbak¹r, to mark the funeral ceremony of four PKK members, escalated into violent protests. Ten people, including four minors, were killed, eight of them from gunshot wounds. Many demonstrators and police officers were injured. Investigations into the killings were continuing at the end of the year. The demonstrations spread to neighbouring cities; two demonstrators were shot dead in the town of K¹z¹ltepe, a stray bullet killed a boy aged three in the city of Batman, and in Istanbul three women died when a bus crashed after being set on fire by demonstrators.
In September a bombing in a park in Diyarbak¹r resulted in 10 deaths. The perpetrators were unknown.
Attacks by armed groups
Bomb attacks targeting civilians increased. An armed group, the Kurdistan Freedom Falcons, claimed responsibility for bomb attacks including in Istanbul, Manavgat, Marmaris and Antalya, in which nine people died and scores were injured. In March, in the city of Van in the east of the country, a bomb exploded next to a minibus, leaving two civilians and the bomber, a PKK member, dead.
The PKK announced a unilateral ceasefire with effect from 1 October, and there was a subsequent decrease in armed clashes.
In May, an armed attack on judges at the Council of State (the higher administrative court) resulted in the death of a judge, Mustafa Yücel Özbilgin, and the wounding of four other judges. The trial of the gunman and of eight others for the attack and for three bomb attacks on the premises of the newspaper, Cumhuriyet, began in August in Ankara.
In February, former PKK executive Kani Y¹lmaz, one of the founders of the Patriotic Democratic Party of Kurdistan (PWD), and PWD member Sabri Tori were assassinated in a car bomb attack in Suleymanieh, northern Iraq, continuing a pattern of assassinations allegedly carried out by the PKK against the PWD.
Torture
There were continued reports of torture and ill-treatment by law enforcement officials, although fewer than in previous years. Detainees alleged that they had been beaten, threatened with death, deprived of food, water and sleep during detention. Some of the torture and ill-treatment took place in unofficial places of detention.
• In October, Erdal Bozkurt reported that he was abducted in Alibeyköy in Istanbul by men identifying themselves as police officers, put into a car, blindfolded and handcuffed, beaten and threatened with death, and taken to a place where he was tortured and interrogated for a whole day about his and other people's involvement in a local group which had been protesting against drug dealers and social problems in their neighbourhood. He was released the following day.
There were widespread allegations by adults and minors of torture and ill-treatment during the mass detentions in the course of riots in Diyarbak¹r in March.
• Two 14-year-old boys reported that they were held for around nine hours at the Çarô¹ police station, stripped naked, made to pour cold water over each other, were threatened with rape, made to lie on a concrete floor, and were forced to kneel down with their hands tied behind their backs while being repeatedly beaten with fists and truncheons and kicked by police officers. Medical reports showed signs of their ill-treatment. They were later transferred to the Children's Department of the Police in another district.
Impunity
Investigations into violations by members of the security forces continued to be deeply flawed and there was a general unwillingness among elements of the judiciary to bring those responsible to justice.
• In February, a decision was made not to pursue an investigation into the alleged torture of five male teenagers in October 2005 in the town of Ordu.
• Two gendarmerie intelligence officers and an informer received prison sentences of over 39 years for the bombing of a bookshop in the town of ¤¤¤emdinli in November 2005, in which one man died. The court's verdict stated that the men could not have acted without the involvement of their seniors. Pending appeal at the end of the year, the case exposed the serious obstacles to bringing to justice senior members of the security forces suspected of committing violations.
Interference in justice system
The ¤emdinli bombing trial (see above) proceeded after an investigation into the bombing which appeared to have been mired by political interference by members of the government and senior military personnel. The Public Prosecutor's indictment was made public in March, and implicated the head of the army's land forces and other senior local military personnel in Hakkari province. The Public Prosecutor requested a separate investigation by the military prosecutor to establish whether the bombing was part of a wider conspiracy. The Ministry of Justice investigated the Public Prosecutor for possible misconduct and in April the Higher Council of Judges and Prosecutors dismissed him from office. An appeal by the Public Prosecutor was unsuccessful.
Fair trial concerns
Those charged under anti-terrorism legislation continued to face lengthy and unfair trials in the special Heavy Penal Courts which replaced the State Security Courts abolished in 2004. Prosecutors relied on evidence based on statements allegedly extracted under torture. Retrials, following judgements by the European Court of Human Rights that trials were unfair, were not impartial and did not re-examine evidence. Proceedings were excessively prolonged, and provisions limiting pre-trial detention had not yet become law and did not adequately address the need to complete a trial within a reasonable time.
Prison conditions
Prisoners continued to report ill-treatment, arbitrary and harsh disciplinary punishments and solitary confinement or small-group isolation in "F-type" prisons. In September the European Committee for the Prevention of Torture (CPT) issued a report relating to its December 2005 visit to places of detention in Turkey, calling for a significant increase in the amount of time allowed for prisoners to associate with each other and commenting on the "very harmful consequences" of an isolation-type regime which could lead to "inhuman and degrading treatment". The CPT also reiterated the call it made in 2004 for a full-scale review of prison health care services.
Conscientious objectors
Conscientious objection was not recognized and no civilian alternative was available.
• In a retrial in October, Sivas Military Court sentenced Mehmet Tarhan to two years and one month's imprisonment on two charges of insubordination following his refusal on two
occasions to perform military service.
Violence against women
There was little progress in implementing the provision in the 2004 Law on Municipalities, which stipulated the need for shelters for women victims of domestic violence in towns with a population of more than 50,000. Women's organizations called for additional funds from the government to implement the law. A circular from the Prime Minister in July, outlining measures to combat violence against women and children, and to prevent so-called "honour killings", represented a step towards acknowledging an entrenched and endemic problem. In December, Parliament passed revisions to the Law on the Protection of the Family, widening its scope.

Conscientious objectors continued to be imprisoned. There were reports of intimidation of independent journalists. The Ombudsperson was removed from her post in January by a presidential decree that she alleged was unconstitutional.
Conscientious objectors
Armenia did not release conscientious objectors to military service, in defiance of its obligations and commitments undertaken when acceding to the Council of Europe to respect the right to freedom of thought, conscience and religion, and despite the introduction of an alternative civilian service to military service in national legislation in July 2004. Conscientious objectors continued to complain that in both its legislative framework and implementation, Armenia's alternative service was under the supervision and control of the military and so did not constitute a real civilian alternative to military service. As of November there were reportedly 48 Jehovah's Witnesses and one Molokan (a member of a Russian religious minority) in detention for draft evasion. Forty-four of the Jehovah's Witnesses had been tried and sentenced to terms ranging from 18 to 48 months' imprisonment. The remaining four were charged and awaiting trial.
In January an amendment to the criminal code was adopted making conscripts who refuse to perform alternative service liable to imprisonment. In May, 19 men, all Jehovah's Witnesses, filed an appeal with the European Court of Human Rights to prevent retrospective prosecution for their abandonment of the alternative service in 2004. Fifteen of the 19 applicants had been arrested in August 2005 and sentenced to between two and three and a half years' imprisonment under existing articles of the criminal code dealing with desertion from military service rather than refusal to perform alternative service. Although their convictions were later overturned and all were subsequently released, the courts refused to formally acquit the men. The case was dropped in November when all 19 were acquitted and all charges against them dropped.
• In October a decision of the Court of Appeal granted a prosecutor's request for a stricter sentence to be handed down to Jehovah's Witness Hayk Avetisian. His sentence was increased from 24 to 30 months.
Freedom of expression
Human rights activists and the Ombudsperson's Office expressed concern over incidents of intimidation and harassment against independent journalists, including two assaults, death threats and the stoning of personal property.
• On 6 September, Hovannes Galajian of the Iravunk newspaper was beaten by two unidentified men outside his home. The attack followed the publication of a number of articles criticizing prominent officials.
• In July the network of independent journalists Hetq Online received threats of reprisals, including death threats, if its journalists continued to publish articles concerning the illegal acquisition of land for redevelopment.
Ombudsperson removed from office
Ombudsperson Larisa Alaverdian was removed from her post in January by presidential decree and her duties entrusted to an interim three-member commission. She alleged that her removal and replacement were unconstitutional because a presidential prerogative either to dismiss the Ombudsperson or to replace that post by another body was not provided for in Armenian law. She and other human rights activists alleged that her removal had been prompted by her criticism of government policies and practices. A new Ombudsperson was elected by the National Assembly in February.
Human rights lawyer released on bail
Lawyer Vahe Grigorian, known for his advocacy work for families resisting forced eviction for government-led redevelopment programmes in central Yerevan, was released on bail in February. He had been held since October 2005 on charges of fraud which he alleged were unfounded and politically motivated. The charges against him were not dropped and the case was still pending at the end of the year.
